Summary
Police detention while exercising freedom of expression at our favourite
Durban venue ‑ the wonderful South Beach Fan Fest ‑ on the weekend,
followed by (taped) discussions with police, together leave me worried.
They should worry you, too.

Police officials say they received orders from City Manager Mike
Sutcliffe that Fifa’s property rights overrule our foundational
Constitutional rights in a vast area stretching from Moses Mabhida
across the beachfront.

“We can charge you and detain you until the 11th of July, Fifa is
over!,” shouted a top officer during my interrogation on Saturday.

And politely questioning Sutcliffe about whether we could use City Hall
steps for Saturday’s anti‑xenophobia rally, my CCS colleague Baruti
Amisi (a Congolese refugee) received this email reply last Thursday: “It
appears you are not a South African and are clearly uninformed about the
role of Fifa. In brief, we are an independent country and except for the
stadium precinct, Fifa have no role in running the city.”

Getting permission for the rally was, as ever, like pulling teeth. The
police were informed in writing on June 19 but it was last Friday
afternoon before rally approval was granted to a coalition that included
the KZN Refugee Council, Diakonia and the Durban Social Forum.

A group quickly brought 1000 fliers to the beach to let people know.
Minutes later, visiting doctoral candidate and filmmaker Giuliano
Martiniello, research student Samantha Sencer‑Mura and I were accused of
ambush marketing and incitement.

I was detained for hours during both early games’ half‑times, missing
(thank goodness) the pain of seeing my favourite Latin American teams
clobbered by Europeans. The top‑heavy security force included police
generals, Crime Intelligence, the Commercial Branch and even the
National Intelligence Agency.

We are, of course, lovers of World Cup soccer and haters of Fifa, like
most people who give this distinction a moment’s consideration. The
Zurich crew will take home R25 billion in profits, pay no taxes, ignore
exchange controls, trickle nothing down, commercialise all aspects of
the game, copyright words like “World Cup”, overcharge for everything,
declare ‘exclusion zones’ that stretch for miles, muffle journalists
with no‑criticism accreditation requirements, and trample on our freedom
of expression.

Moreover, many bitter players and fans believe Sepp Blatter’s main
legacy is the quaint ‑ or, hinted Lord David Triesman of the English
Football Association a few weeks ago, bribe‑friendly? ‑ refusal to adopt
goal‑line technology needed to correct egregious referee errors.
(Blatter instead, apparently, focuses all Fifa’s camera‑power on
potential ambush‑marketers in the crowd.)

Illustrating how constrained our rights are, I asked one police
superintendent (name withheld), “What if I say ‘Viva Argentina!’ in the
fan park? No problem? What if I say ‘Phansi Fifa phansi!’?”

“Then you’re wrong,” he answered. “You can’t say, ‘Phansi Fifa phansi’.”

Sutcliffe’s control fetish appears to be the central barrier. As a
police superintendent put it, “He’s the one who has instructed us that
we must enforce. He comes in our meetings.”

“And what does he say? He says he doesn’t want any anti‑xenophobia?”

The police superintendent replies, “No distribution of pamphlets,
especially which mention xenophobia.”

Ah, the underlying problem had emerged. The reason the pamphlet was
banned was not just procedural, it was political. “You are reminding
[people] of xenophobia. Even myself I had forgot about that thing, but
now you write it down.”

“Do you think it is not a problem?,” I asked. Surely Durban police know
that a city councilor is amongst those still being tried for the
xenophobic murder of a Tanzanian and Zimbabwean last year, and that the
streets and worksites are thick with tension and insults against
immigrants and refugees.

His rebuttal “It happened. Then government stopped it there.”

“I’m sure you know that Jacob Zuma said xenophobia’s a problem,” I
replied, and that after meeting his national executive in May, the
president “said the ANC branches must work against xenophobia,” I
reminded the superintendent.

“There is no xenophobia”, he insisted – but nervously.

Such denialism parrots ANC spokesperson Jackson Mthembu’s written
statement earlier that day: “The reported xenophobic attacks by South
Africans on foreign nationals, particularly from the African continent,
after the conclusion of the 2010 FIFA World Cup in South Africa, is
baseless and without any rational” (sic).

And yet the army is occupying the town of Denoon precisely because the
threat could explode into 2008‑type violence.

Behind Sutcliffe’s arrogance in declaring such a large a
Constitution‑free zone, is the Constitution drafters’ ambiguity, with
the Bill of Rights potentially interpreted as allowing corporate
property rights to trump human rights. Section 8(4) gives foundational
rights to ‘juristic persons’, i.e., institutions including for‑profit
businesses like Fifa.

In 1996, alongside former ANC Member of Parliament Langa Zita and
Darlene Miller (a sociologist at the Human Sciences Research Council),
we formally warned a Constitutional Court certification hearing that
this provision could “undermine the constitutional rights of natural
persons to freedom of expression, freedom of association in organs of
civil society, access to information, the rights to life, security of
the person, and a safe environment.”

So it seems we were right, sadly. Likewise, in the US, a similar
degeneration of political rights occurred this year when the Supreme
Court lifted limits on corporate spending to influence elections.

According to professors Chris Roederer and Darrel Moellendorf – in their
Juta Press book Jurisprudence – our case is an example “of the law
serving to stabilize capitalist property relations” because “the final
Constitution contains no assurance that when the rights of juristic
persons conflict with those of natural persons, the rights of the latter
shall prevail.”

On the other hand, the 1996 Constitutional Court ruling against us did
at least concede that section 8(4) “recognises that the nature of a
juristic person may be taken into account in determining whether a
particular right is available to such a person or not.”

That’s why the stance of the City Manager and police honchos is so
counter‑revolutionary, against the ANC’s attested democratic values. The
right to inform about a xenophobia rally during a halftime break surely
should be declared a ‘particular right’ overriding Fifa’s exclusions,
given how much is at stake.

If they don’t come to their senses, will we again face police detention
as we leaflet the Fan Fest and stadium crowds demanding, firstly, our
Constitutional rights restored, secondly that Fifa finance some new
township soccer pitches before they leave town with the cash, and
thirdly that they adopt goal‑line technology, already!?

After the pixie‑dust

No matter how hard we cheered last night, the demise of Bafana Bafana’s
campaign will at least blow away much pixie‑dust from the World Cup.
Today our eyes are left clearer to comprehend problems that
soccer‑loving cynics have long predicted: loss of large chunks of state
sovereignty to Fifa, massively amplified income inequality, and future
economic calamities as debt payments come due – and soon also xenophobia?

The crucial question in coming weeks is whether instead of offering some
kind of progressive resistance, as exemplified by the Durban Social
Forum coalition rally last Wednesday at City Hall, will society’s sore
losers adopt right‑wing populist sentiments, and frame the foreigner?

This is not an idle concern, as the Facebook pages of hip young Joburg
gangstas exploded with xenophobic raves after Uruguay beat Bafana last
week.

Recalling the May 2008 violence that left 62 people dead and more than a
hundred thousand displaced, President Jacob Zuma had told his party
executive in May that “The branches of the ANC must start working now to
deal with the issue of xenophobia”.

Replying that “There is no tangible evidence,” Police General Bheki Cele
added, a few days later: “We have observed a trend where foreigners
commit crime ‑ taking advantage of the fact that we have an unacceptable
crime level ‑ to tarnish our credibility and image.”

Generalizations against ‘foreigners’ as prolific perpetrators of crime
are baseless, as no scientific ‘trend’ can be discerned because no
reliable data exists to confirm whether immigrant tsotsis represent a
greater ratio of their numbers than indigenous tsotsis. (We don’t even
know roughly, to the 500 000th, how many immigrants there are in South
Africa.)

Instead, the state should address root causes for social stresses
expressed as xenophobia: mass unemployment, housing shortages, intense
retail competition in townships and South Africa’s regional geopolitical
interests which create more refugees than prosperity.

If we thought (as did I) that the replacement of Mbeki with Zuma might
mean a change in Pretoria’s foreign policy so as to end the nurturing of
Robert Mugabe’s repression, then that was naïve, as Zuma showed in
London by lobbying hard for an end to smart sanctions a few weeks ago.

These men are simply unwilling to reverse a 120‑year old structural
relationship of exploitation, by which SA companies – such as those
involved in eastern Zimbabwe’s bloody Marange diamond fields, controlled
by Mugabe’s army – rip off the region. The Pretoria‑Harare arrangement
has given rise to more than two million desperate border‑jumpers, in
turn fueling SA worker resentment.

One victim of collusion, Zimbabwean civil society researcher Farai
Maguwu, was jailed last month because a South African officer of the
Kimberley Process with strong family connections to Marange‑related
corporations allegedly set up Maguwu with Mugabe’s police, then issued a
report finding that Marange complies with international diamond trading
guidelines.

Several major SA mining houses stand to benefit if a Kimberley Process
summit underway in Tel Aviv today decides that Zimbabwe is ‘clean’.
(Maguwu's bail was denied on Monday so he can't be there to make his
scheduled input.)

But if the South African's report is approved, leading civil society
groups like Human Rights Watch promise that the Kimberley Process
reputation for monitoring blood diamonds will become as soiled as
Mbeki‑Zuma’s when it comes to Pretoria’s promotion of justice and
democracy in wretched Zimbabwe.

Given such relationships, it’s not surprising that a UN High
Commissioner for Refugees report last week records 158 200 Zimbabweans
currently seeking formal asylum, 90% of whom are in South Africa. That’s
more than three times as many as the second‑place country, Burma, which
was followed by two Washington‑backed regimes: Afghanistan and Colombia.

Indeed if Cele intends going after foreign criminals he might
concentrate a bit more of his force’s effort on a really dangerous crew:
Fifa. With the possible exception of Wall Street and the City of London,
no more larcenous a gang of white‑collar thugs are to be found than in
Zurich, both in the banks which financed apartheid when no one else
would, and at their hideout at Soweto’s Soccer City.

The latter mafia is so self‑confident in dealing with General Cele’s
mentally‑corrupted South African Police Service that last Friday, Fifa
general secretary Jerome Valcke openly bragged how they will spirit away
R24 billion (50% more than the $1.8 billion taken from Germany four
years ago). Fifa pays no taxes, ignores exchange controls, and is quite
likely preparing South Africa for a currency crash in the process. ‘Fick
Fufa,’ say many in disgust.

To ensure the heist is complete, Cele’s police are obviously on the
take, observers confidently conclude ‑ but not because there’s evidence
of Fifa’s fabled fraud squad at work. No, just as debilitating is the
above‑board commercial, contractual corruption in evidence these past
few days:

in the service of the Stallion Security labour brokers, who should have
been banned last year (as promised by Labour Minister Shepherd
Mdladlana), the police enforced an exploitative low‑wage regime, heaving
stun grenades and tear gas at unpaid workers, even shooting a bystander
multiple times with rubber bullets;

no wonder, because Linda Mti – the former prisons commissioner linked
financially to the notorious, privatized Lindela transit camp for
arrested immigrants ‑ is head of security for Fifa’s Local Organising
Committee;

defending that pissy US beer Budweiser, SAPS were again at Fifa’s
service when they arrested two Dutchwomen, whose subtle ambush marketing
last week amounted merely to orange dresses with a tiny Bavarian beer logo;

at the Fan Fest at South Beach, police arrested local environmentalist
Alice Thomson last Monday for passing out anti‑Fifa fliers regarding the
June 16 march to City Hall; and

a man caught with 30 game tickets ‘and no explanation’ got a three‑year
jail sentence, while hardened criminals roam the streets freely.

Thieving and trademarking culture too, Fifa and corporate partner
CocaCola also tried to steal Africa’s soul by paying Somali singer
K’naan to raise spirits with his easy lyrics.

But that won’t work, for much more challenging tunes for Fifa to digest
have been produced – and are free to download on the internet ‑ by
hip‑hop artists Nomadic Wax (Dakar) and DJ Magee (‘World Cup’), Chomsky
AllStars (‘The Beautiful Gain’) and, best of all, Durban’s own Ewok
(‘Shame on the Beautiful Game’).

And on July 3, another City Hall rally – this time against xenophobia ‑
will let Durban reproduce a genuine African ubuntu spirit that can
withstand Bafana’s defeat, Fifa’s profiteering and all the other losses
we are suffering.
